I am taking a moment to do something I rarely do on this site, which is post a blog article. Most readers will have never heard of me as I just do uploading on rare occasions when needed. I am posting today in answer to the article in the Appeal Democrat. Yubacounty59 (my big Sister)made a series of posts explaining how things really led to the DA dismissing the case. We did not expect District Attorney Pat McGrath to do anything other then cover his political rear end, which he thinks was accomplished today. The Appeal Democrat slanted to give the DA plenty of face time and minimizing the statement made by attorney, James T. Riley of Summit Defense. Rather than printing the statement in it’s entirety, the writer of the article keyed in on one point and left the rest out. No surprise there. I am sure if the Appeal Democrat actually called out some of the points against the District Attorney’s office and Court proceedings they would lose access to quotes in the future. I do not read the Appeal Democrat because there are superior ways of getting news on the internet without needing the A.D. The lack of printing the statement below in it’s entirety just solidifies my choice.
Much can be brought out on this, but I am leaving that to the discretion on how and when and if my Father would like to release it. I will be around to scan and upload whatever he needs. I do want to offer the scans of the complete statement as written by Mr. Riley since the Appeal Democrat saw fit to gloss over. I hope they are large and clear enough. If not I will happily adjust them tomorrow. The statement says much about what a professional lawyer who is not part of the system here in Yuba County can see just from the Court Transcripts of the first trial.
If this worked right you should be able to click on the pages and they will open in a larger format in a window. If not, I will fix it ASAP. Compare those statement pages to that article in the Appeal Democrat and I think you will see why I have no care to use them as a source of news.

Thank you Piratebob, this is where the truth can be said and I appreciate your posting of Mr. Riellys Statement to the Appeal democrat. You are right, the Appeal democrat has slanted this case towards the County D.A. in hopes of helping them Send me off and out of their corrupt way. That is the way it goes, this Editor leans toward helping the upper management of Yuba county continue hiding the whereabouts of Upwards of $400,000,000 in Levee funds. Given the fact County management has in plans to build a “New ” town near Highway 65 & 70 and block any attempt of Citizens to upgrade the existing town of Linda, through not following Constitutional Law but following their own spin “laws” or just not following the laws we have in place. I believe the Levee funds that TRLIA and YUBA COUNTY officials failed to Account for in 2004-2005-2006 partially are being used for County uses other than Flood control, too many times County Administrator Robert Bendorf has “Found” ten million here and Eight Million there too many times and that either shows non accounting is widespread in Yuba county Management or the “findings ” are from the unaccounted Flood Control grants and fees. There in lies the reason the County will not account for the funds through an audit now in 2010, as requested by the citizens.
The County Supervisors recently stated while hiring Bendorf for two more years, “We generally approve of their management.” The Board of Supervisors have to be aware of the Non accounting of upwards of $400,000,000 after all the publicity and they “Generally” approve of it.
Why do we the people not rise up and throw the bums out? We are still asleep? Do We want to let the Upper management return us to the rule we left England and the other country’s that had the type of Rule with no representation that appears to be where Yuba County is heading?
The Citizens of Yuba County no longer have places to work in the County to speak of and have not had since 2004 when the County Officials under Logue, Mallen , Bendorf and Others chose to put the County’s eggs all in the Development Basket which after the Bubble Burst, sent the County towards Bankruptcy. They were wrong then and they are all still in management in Yuba county government, except Logue, they are still paying themselves over exuberant salary’s, and, the County is still sliding into bankruptcy. Oh, and the Board of Supervisors still “Generally” approve of their management. Why?
